The Court ruled that the defendant, a former dealer of a selective distribution car network, by using plaintiff’s well-known trademarks, gave a misleading impression to consumers that he is still an authorized dealer and therefore is obliged to remove -within 10 days from the service of the decision- the signage depicting the well-known trademarks of the plaintiffs and to cease and desist from further using said trademarks.
Moreover, the Court ordered the publication of the operative part of the decision in a newspaper at defendant’s expense, while it threatened a monetary penalty of 300€ for each infringement of the cease-and-desist order.
Nikos Grigoriadis argued for the plaintiffs.
