In a dispute between a former distributor/member of a selective distribution car network, a supplier, and proprietors of well-known trademarks, the Court ordered the distributor, due to the termination of the distributorship agreement, to cease and desist from using the plaintiffs’ trademarks and to stop giving the false and misleading impression that he still belongs to the selective distribution car network, imposing a monetary penalty of € 3.000 foreach future infringement of that order.
The Court also ruled that the defendant is obliged to remove the signage containing the well-known trademarks from its premises (including its website), imposing a monetary penalty of € 1.000 for each day of infringement of that order in the future. The Court authorised the supplier to publish the operative part of the decision to newspapers at distributor’s expense, while it also imposed on the distributor a monetary penalty of € 3.000 for each future infringement of the operative part of the decision.
The Court also ordered the former distributor to pay moral damages to each plaintiff in the amount of € 8.000 .
Nikos Grigoriadis argued for plaintiffs-proprietors of well-known trademark.
