In a dispute between a former distributor/member of a selective distribution car network and a supplier-proprietor of well-known trademarks, the Court obliged the distributor to cease and desist from using the plaintiffs’ trademarks and to stop giving the false and misleading impression that the distributor still belongs to supplier’s selective distribution network.
The Court also ruled that the defendant is obliged to remove -within 10 days from the service of the decision- the signage depicting the well-known trademark from its premises. The Court allowed the supplier to publish the operative part of the decision to newspapers at distributor’s expense, while it also imposed a penalty of 3.000 € for each future infringement of the operative part of the decision by the distributor.
The Court also ordered the former distributor to pay to plaintiff moral damages amounting to € 8.000.
Nikos Grigoriadis argued for plaintiffs-proprietors of well-known trademark.
