The Court, acknowledging the plaintiffs as the owners/licensees of well-known trademarks, obliged the former distributor, due to the termination of the distributorship agreement, to cease and desist in the future from the use of the plaintiffs’ trademarks and to stop giving to consumers the false impression that still belongs to supplier’s selective distribution network, imposing a monetary penalty of 1.000 € for each future infringement of that order.
The Court also ruled that the defendant is obliged to remove -within 30 days from the service of the decision- the signage depicting the well-known trademark of the plaintiffs from all its premises imposing a monetary penalty of 1.000 € per day of non-compliance with that order.
The Court also obliged the former distributor to pay each plaintiff moral damages of 2.000 € .
Nikos Grigoriadis argued for plaintiffs-proprietors of the well-known trademarks.
