The Court ordered the former distributor to cease and desist in the future from using the plaintiffs’ trademarks and to stop giving to consumers the false impression that it still belongs to supplier’s selective distribution network. Also, the Court ordered the distributor not to use similar signage to the signage in question.
The Court also ruled that the defendant must remove -within 10 days from the service of the decision- the signage containing the well-known trademark of the plaintiffs from all its premises, imposing a monetary penalty of €1.000 per day in case of non-compliance.
