A pharmaceutical wholesaler brought two lawsuits before the Court requesting in natura compensation and specifically requesting from the Court the pharmaceutical company to be obliged to supply the wholesaler with all quantities of the pharmaceutical products ordered by the latter, as well as compensation for loss of profits.
The lawsuit was based on Greek and EU’s competition legislation, on Greek unfair competition law and pharmaceutical legislation, and on articles 28 and 29 of the Treaty of the functioning of the EU.
The lawsuits were rejected in their entirety as vague and non-legitimate.
Nikos Grigoriadis co-represented the defendant-pharmaceutical company.
